Refinance Loan

Question: Why would my ex-husband's mortgage company be asking for my refinance loan papers?

My ex- husband is trying to purchase a house. When we divorce we agree that I give him a settlement. He got the settlement. Now, his mortgage company want to see my refinance papers to make sure that I really gave him the money that they see in his account. I told him that I will not give them my personal information, but I will give them a copy of our stipulations and agreement papers which are notorized and signed. If they are not satisfied with this, then I can't help them. What is the big idea? It seem like when you divorce someone you can't get rid of them. But, my personnel refinance papers with my personnel information on it. I do not trust that company anyway because my mom had a loan with them and her identity was stolen.

You are under no obligation to talk to these people unless you are applying for the loan. Tell them to take a long walk off a short pier. Your ex-husband has all the documentation necessary.

Lenders have to verify where money comes from when a large deposit is made into a borrowers lender. If his current balance is several thousand dollars more than what it was a month ago they will need evidence the money came from you for this settlement. Just provide them with either the Settlement Statement if you paid him at the time of the refi or a copy of the cancelled check from you. This should be enough to satisfy the lender, the Settlement Statement wouldn't have any info on it besides your name and address and although a copy of the check would have bank info it doesn't have overly personal info like your SSN. If you don't provide him he can always contact his own bank and order a copy of the cancelled check from them most banks keep copies in their system of all deposited checks, you just have to ask.

If all they want is proof of where the funds came from then ask them if a notarized letter from you stating that you paid the money to him on XXX date along with your court documents will suffice. that should be more than enough to prove where the money came from.
